Effective Date: June 8, 20241. IntroductionWelcome to Kai Watanabe Photography (“we,” “us,” “our”). These Terms of Service (“Terms”) govern your use of our services as a freelance filmmaker, videographer, and photographer. By engaging our services, you agree to be bound by these Terms.2. Services ProvidedWe offer professional filmmaking, videography, and photography services, including: • High-quality short form videos for your business for social media • Brand promotional videos • Creative video production and photography • Photography valuing art and quality3. Client ResponsibilitiesTo ensure the success of our collaboration, clients are expected to: • Provide accurate and complete information regarding the project. • Communicate any specific requirements or preferences in advance. • Ensure availability for scheduled shoots and meetings. • Obtain necessary permissions and permits for shooting locations when suggested by the client. If drone permissions are needed, we will handle obtaining those permissions.4. Booking and Payment Terms • Booking: Payment is due upon completion of the project. • Payment Methods: We accept payments via bank transfers, PayPal, and Deel. We can negotiate on your preferred method. • Late Payments: Late payments may incur additional fees of 1.5% per day of delay.5. Cancellation and Refund PolicyCancellation Fees:Cancellation fees apply to confirmed bookings that are canceled within a certain timeframe: • Up to 14 days before production: No fee. • Within 14 days: 20% of the total project cost. • Within 7 days: 40% of the total project cost. • A day before: 80% of the total project cost. • On the day: 100% of the total project cost.Schedule Changes:We understand that plans can change. Schedule changes are subject to the following fees: • Up to 14 days before production: No fee. • Within 14 days: 10% of the total project cost. • Within 7 days: 20% of the total project cost. • A day before: 40% of the total project cost. • On the day: 80% of the total project cost.6. Intellectual Property Rights • Ownership: We retain all rights to the photos and videos created during the project. Clients are granted a non-exclusive, non-transferable license to use the content for personal or commercial purposes as agreed. • Usage: Clients may not alter or resell the content without our prior consent. We retain the right to use the delivered photos and videos for our portfolio and experience.7. ConfidentialityWe respect your privacy and will keep all information regarding your project confidential, except as required by law or necessary to perform our services.8. Liability Limitations • Service Provision: We strive to provide high-quality services but do not guarantee specific outcomes. Our liability is limited to the amount paid for the services. • Force Majeure: We are not liable for delays or failures caused by circumstances beyond our control, such as natural disasters, accidents, or other unforeseen events.9. Dispute ResolutionIn the event of a dispute, we will first attempt to resolve it amicably through negotiation. If a resolution cannot be reached, the dispute will be resolved under the laws of Japan through mediation or arbitration in Kyoto, Japan.10. Governing LawThese Terms are governed by and construed in accordance with the laws of Japan.11. Changes to These TermsWe may update these Terms from time to time. Any changes will be posted on our website with an updated effective date.12.
